LET’S WORK, NOT MANIPULATE
The COST Ukraine publication regarding procurement procedure by Ukravtodor of “Carrying out monitoring of road conditions and road works quality” appeared in the Internet. As a result, the Facebook comments regarding "betrayal" and something like that began again. Really, when looking on the “iceberg peak”, you can only think of a "great betrayal" and the theft of funds and other terrible misfortune.
We did not want to comment this outright manipulation because we know who are the authors of the publication and understand their interests. But as long as due to this “misinformation” the reputation of “DerzhdorNDI” State Enterprise is compromised and we cannot stay aside.
Several basic things:
1. Technical supervision of the construction objects, road conditions and road works quality monitoring are different things.
2. Possible subject for discussion is the duplication of functions of this procurement with technical supervision or the inappropriateness of its performing. That is for better understanding. But what is the reason for changing the concept and misleading the society? Your experts who advise you are well aware of different types of control: initial, operational, acceptance. They are also aware of the need in monitoring of quality by Ukravtodor within the so-called "inspection control"!
3. Acceptance control will be carried out with the participation of certified engineers of technical supervision, who are, by the way, independent of customers (and Road Services have already begun announcing individual procurement procedures for this), and so-called "inspection control" (we emphasize – this is monitoring, not quality control) and organization that will win this tender of Ukravtodor. Why did you confuse everything? Whose signature will be put on the Act of confirmation that the object’s readiness for operation? You have to know this. Certainly, it will be the signature of an engineer of independent technical supervision, but not of a state organization which will be subordinated to Ukravtodor and which will monitor the state of the roads and the road works quality.
We remind you that in accordance with item 21 of the Regulation on the State Road Agency of Ukraine approved by the Decree of Cabinet of Ministers of Ukraine dated September 10, 2014 No. 439, Ukravtodor shall monitor the construction, reconstruction, repairing and maintenance of roads. And in accordance with item 3.2.6 of DBN “Organization of Construction Production”, the monitoring means continuous and periodic surveying of certain indicators of the object of construction. Ukravtodor has an authority to know what is happening on the objects directly, how the quality control system is arranged, who and how performs their obligations on the object. And this is logical.
Now, concerning the procurement “Monitoring of road conditions and road works quality” by Ukravtodor. The phrase that "only 2 enterprises are admitted" is manipulative. Why do you write "admitted"? Did other companies submit their applications for the procurements and were refused to participate in the auction? Surely, you will oppose us and insist that Ukravtodor had prescribed such discriminatory conditions that nobody wanted to participate in the tender. And what about the right of any organization to lodge a complaint to the Antimonopoly Committee? Why nobody challenged such conditions? Especially, since the new law on public procurement has not yet come into force, the fee for lodging a complaint is still small. In addition, anyone could ask questions in the process of procurement or request to eliminate any possible violations.
Once again we emphasize that Ukravtodor announced the procurement through Prozorro in English and anyone (including independent and powerful foreign companies) could participate in this tender. Any potential participant could file a complaint. But we assume that the foreigners were not interested in this procurement because the scope of work is too big for such small funds. The level of salaries of foreign professional consulting engineers differ incomparably from ours, which is probably the true reason for the lack of interest in participating in this tender. And, as a rule, you are all well aware of the result of the mission of a foreign company - it hires our domestic specialists with the equipment and experience for the sixpence subcontract.
As for the discrepancy of the supporting documents submitted by “DerzhdorNDI” SE to the requirements of the tender documentation, we certainly have no right to evaluate the actions of Ukravtodor tender committee. However, we consider COST Ukraine's conclusions regarding the inconsistency of the confirmed tender documents submitted by “DerzhdorNDI” SE to the tender documentation to be unprofessional.
We can only state the following. “DerzhdorNDI” SE adheres to all the necessary rules of records management, with regular checking on this issue, and therefore documents are not registered at a future date. We invite the experts of COST Ukraine to check it personally. And please do not slander, be careful too, you have all confused, such registration No. of letter does not exist and the reference that you refer to has the identification No. 19.1-3-372 dated 24.03.2020. Once again, check it carefully at Prozorro.
As for the inability to confirm the experience of similar works performance on scientific and technical works support at the stage of designing, we will not even comment specifically, study carefully DBN B.1.2-5: 2007. Scientific and technical support is provided at all stages of the object's life cycle.
One can comment this situation for a long time.
But we call everyone to respect each other's work and cooperate constructively. I really wanted to see real practical cases from COST Ukraine regarding the settlement of the situation with the road works quality control, and not just on the level of Facebook posts , presentations or reports. And we hope to see it in the form of legislation or regulations, state building norms or national standards.
